WangYuYun Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") form an agreement between you and Vigorously LLC ("we", "us") governing your use of WangYuYun (the "Service"). By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please stop using the Service and uninstall the app.

If you are under 18, please read these Terms with a parent or guardian and use the Service only with their consent.

2. The Service

The Service provides an encrypted network tunnel intended to protect the privacy and integrity of your traffic on untrusted networks. The Service is provided on an "as is" basis. We work continuously on availability and speed, but we do not guarantee connectivity or throughput for any particular route or time period.

The Service is not an anonymity tool and does not exempt you from the laws that apply to you. You remain responsible for everything you do through the Service.

3. Accounts

3.1 You may register with an email address, or start a trial directly from the app using a device identifier. Either way, the account and its entitlements are for your own use.

3.2 You are responsible for safeguarding your credentials. Losses arising from your failure to do so are your own. If you suspect unauthorised access, contact us at support@wangyu.cc immediately.

3.3 One account may be signed in on several devices, but the number of simultaneously connected devices is limited by your plan. Beyond that limit, older connections may be dropped.

3.4 You may not transfer, lend, resell, or otherwise share your account with the public. Accounts used for resale or distribution may be terminated.

4. Acceptable Use

You must not use the Service to:

• carry out any activity that is unlawful where you are or where the server is located;
• access, scan, penetrate, or interfere with computer systems or networks without authorisation;
• send spam or bulk unsolicited messages, or conduct phishing or fraud of any kind;
• distribute malware or ransomware, or participate in a botnet;
• launch or take part in denial-of-service attacks;
• infringe the intellectual property, trade secrets, or personal rights of others;
• create, distribute, or store content prohibited by law;
• mine cryptocurrency, run large-scale scraping, or otherwise consume a disproportionate share of shared bandwidth;
• circumvent traffic metering, device limits, or billing controls.

We may restrict or terminate your Service without prior notice for any breach of this section, with no refund of amounts already paid. Where unlawful activity is suspected, we will cooperate with competent authorities as required by law.

5. Plans, Traffic, and Billing

5.1 The Service is sold as plans. The data allowance, validity period, device limit, and price of each plan are those shown at the time of purchase.

5.2 Traffic is billed on the basis of signed usage reports from our server nodes. Figures shown in the app are indicative only; where they differ, server-side records prevail.

5.3 When a plan expires or its allowance is exhausted, connections are dropped while the account itself is retained. You may renew or buy a data pack to restore service.

5.4 Subscriptions purchased through the App Store or Google Play are collected and renewed by those platforms. Cancellation must be done in your platform account settings; we cannot cancel them on your behalf.

5.5 Trial allowances, check-in rewards, and similar complimentary entitlements have no cash value, are non-transferable, and may expire.

6. Refunds

6.1 For orders paid directly on our site, you may request a full refund within 7 days of payment provided no more than 10% of the allowance has been consumed.

6.2 Requests outside that window are assessed individually against actual usage.

6.3 Orders placed through the App Store or Google Play are refunded by those platforms under their own policies. Please apply to the platform directly.

6.4 No refund is available where service was terminated for breach of section 4.

7. Availability and Changes

7.1 We use reasonable efforts to keep the Service available but do not promise uninterrupted operation. Maintenance, routing changes, upstream faults, and force majeure may cause temporary unavailability.

7.2 We may add, change, or retire nodes and features. Where a change materially affects the core entitlements of a plan you have already bought, we will give advance notice by in-app message or email.

7.3 Planned maintenance is scheduled during off-peak hours wherever practical.

8. Intellectual Property

The client software, interfaces, documentation, trademarks, and logos of the Service belong to us or our licensors. Apart from the limited, non-exclusive, non-transferable licence granted in these Terms, you may not copy, modify, reverse engineer, distribute, or otherwise exploit them.

9. Disclaimers and Limitation of Liability

9.1 To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9.2 We are not liable for losses caused by your misuse of the Service, by third-party networks, devices, or software, nor for loss of data, profits, or goodwill, or any indirect or consequential loss.

9.3 Our aggregate liability under these Terms will not exceed the amount you actually paid for the Service in the 12 months preceding the event giving rise to the claim.

9.4 Some jurisdictions do not allow certain warranty exclusions or liability limits; in those jurisdictions the limits above apply to the greatest extent permitted.

10. Termination

10.1 You may stop using the Service and delete your account at any time. See the Account Deletion notice for how.

10.2 We may suspend or terminate your Service if you breach these Terms, if your use materially harms other users or the network, or if required by law or a competent authority.

10.3 Sections on intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

11. Changes to These Terms

We may revise these Terms. Revisions are published at wangyu.cc and in the app before they take effect. Continuing to use the Service after that date constitutes acceptance. If you do not accept the revision, please stop using the Service; unused entitlements are handled under section 6.

12. Governing Law and Disputes

These Terms are governed by the laws of the place of registration of Vigorously LLC. The parties will first attempt to resolve any dispute amicably. Failing that, either party may bring proceedings before the competent courts at that place of registration.

13. Apple App Store Additional Terms

13.1 This section applies when you download or purchase WangYuYun through the Apple App Store. Where it conflicts with another part of these Terms, this section prevails for the App Store context.

13.2 In-app purchases are processed by Apple. Billing, renewal, and refunds for a subscription bought inside the app are handled by Apple under its own terms, and the subscription name, billing period, and price are shown on the purchase screen before you confirm. Subscribing requires no payment beyond the price displayed there and no personal information unrelated to the subscription. Such subscriptions are also governed by Apple's standard Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions.

13.3 These Terms are concluded between you and Vigorously LLC alone, and not with Apple. Apple is not responsible for WangYuYun or its content, and has no obligation to furnish any maintenance or support services for it.

13.4 If WangYuYun fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to WangYuYun. Any claim relating to product quality, product liability, legal or regulatory compliance, consumer protection, intellectual-property infringement, or a third-party allegation that WangYuYun infringes that party's rights is the responsibility of Vigorously LLC and not of Apple.

13.5 You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.

13.6 Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of them, have the right to enforce these Terms against you as a third-party beneficiary.
